In fact, participation in the Boy Scouts was considered to be almost a rite of passage for the average American male. What Are the “Perversion Files”?

Since the Boy Scouts of America was established in 1910 there have been allegations of scout leaders and volunteers abusing young boys. As early as the organization began tracking allegations of misconduct by volunteers, it used the files to quietly remove predators from its ranks, apparently to no avail. 

We now know, for instance, that the BSA has been dismissing suspected child abusers for most of the last century. We also know that in many cases, those dismissals only came after the BSA could no longer ignore clear warning signs that should have been investigated sooner.

The Boy Scouts were forced to release thousands of documents in 2012 after a court order. These documents came to be known as the Perversion Files. It was revealed that the Scouts were aware of abuse in chapters nationwide. Worse, the organization did not report the allegations to authorities, thus covering up the abuse.

Adult volunteers and Scout leaders sexually abused thousands of boys and young men due to their negligence. Oftentimes, sexual predators who are known to be repeat offenders are simply moved to other chapters rather than being expelled, and are allowed to victimize more boys.

California's AB 218 Helps Victims of Boy Scouts Sexual Abuse

A law known as AB 218 entered into effect in California on Jan. 1, 2020. Under this law, the requirements for pursuing claims of childhood sexual abuse were significantly changed by:

  • Adding sexual assault to the definition of sexual abuse, which covers offenses that were previously not considered sexual abuse.
  • It is proposed to extend the statute of limitations for child sexual abuse cases to the later of 22 years after the age of majority, or 5 years after the discovery of childhood sexual abuse. Therefore, survivors of boy scout sexual abuse have until the age of 40 to file a claim, while extending the discovery date provides more time.
  • Renewal of previously barred claims that may fall outside the expanded statute of limitations by creating a 3-year window for submitting claims that were blocked by previous time limits.
  • Victims may recover treble damages if organizations cover up child sexual abuse.
